Former Bayern Munich defender Breno will remain in prison after the German Federal Court opted to reject proposals for his sentence to be revised.

The 23-year-old was sentenced to three years and nine months in a German prison after setting fire to his Munich home in October 2011 while intoxicated.

Earlier this week, reports suggested Breno’s lawyer had claimed his client was under the influence of potentially dangerous medication, which could have caused the events which lead to his imprisonment.

The lawyer also claimed this information had not been taken into consideration by the court previously, and that constituted a formal error which would trigger an automatic revision of the sentence.

However, the court refused the assertion that an error had been made and will therefore stand by the decision not to revise the Brazilian’s sentencing.

Breno’s future career is in doubt amid the controversy, although the defender actually signed a two-and-a-half year deal with São Paulo in December.

The Morumbi outfit released a statement and stressed that they would give Breno “security, stability and, most of all, a perspective”.
