The Spanish Prosecutor’s Office will appeal Dani Alves’ four and a half year prison sentence for rape, in an attempt to obtain a greater sentence. The footballer’s defense had also announced that he was going to appeal the ruling, but to request acquittal.

The judicial body, which during the trial had requested nine years in prison, will argue in its presentation that the 150,000 euros that Alves deposited before the trial should not be considered as “reparation for the damage” and, therefore, be counted as a mitigating circumstance, as considered by the judges of the Barcelona Court.

The Brazilian turned himself in to testify a few hours later. weeks and since then he remained in preventive detention due to the risk of escape.

The judges considered in their ruling that “it was proven that the victim did not consent and that there is evidence, in addition to the testimony of the complainant, to prove the rape.”

The former FC Bacelona full-back, 40, said there was consent and denied having been violent. However, the court rejected his version and explained that “for the existence of sexual assault it is not necessary that physical injuries occur, nor that there be evidence of heroic opposition by the victim to having sexual relations.
