Dani Alves’ mother published on her social networks images and data of the alleged complainant in the rape case for which her son is imprisoned and prosecuted. Pending the start of the trial that will take place in Spain between February 5 and 7, this revelation confirms the victim’s concern about the disclosure of her identity, protected by law, and raises a question about whether it could harm the situation. footballer’s proceedings.

Maria Lúcia Alves uploaded a post to Instagram with the message “those who trust in God never lose the battle”, accompanied by a video in which she exposes private recordings of the alleged complainant after the incident under investigation, which occurred on December 30, 2022 in a nightclub in Barcelona. The soccer player’s mother also disclosed the name and age of the person who would be the complainant, all data that the justice system decided to preserve and that is protected by gender regulations that exist in several countries around the world. Even in Spain, the Criminal Procedure Law governs, which prohibits “the disclosure or publication of information relating to the identity of the victim and data that may facilitate their identification directly or indirectly.”

That same law vetoes “the obtaining, disclosure or publication of images of the victim or their relatives.” This is particularly sensitive in cases of media relevance such as this one, since several press articles published the name and images of the alleged complainant, despite her decision not to make her identity known.

One month before the start of the trial against Dani Alves

Now it will be up to the court to determine whether this dissemination on social networks in any way affects Alves, who was detained preventively since January of last year when considering that there was a risk of escape, and who will be sitting in the dock next month.

The Prosecutor’s Office requested nine years in prison for the footballer, compensation to the complainant of 150,000 euros for the crime of “sexual assault with penetration” and another ten years of supervised or probationary freedom. For her part, the woman who accused the side requested a twelve-year prison sentence, the same amount of compensation and a one-kilometer restraining order for a decade.

For its part, the footballer’s defense demands acquittal by arguing that the sexual relations were consensual.
