The Prosecution of the National Court in Madrid on Wednesday requested the arrest of Neymar for two years because of alleged illegality in the transfer of the player to Barcelona, in 2013.
The decision of the Spanish Public Prosecutor’s Office is based on a complaint from investment group DIS, which formerly held 40% of the economic rights of Neymar. They want a higher percentage of the transfer value involved in the player’s move to Spain. Judge José Perals also wants Neymar’s family to pay a fine of €10 million, and asked for a five-year prison sentence for former Barça president Sandro Rosell, who was the representative of the Spanish club when the striker left Santos. Also on Wednesday, DIS presented its indictment to the court in which they also seek the arrest of all those involved, including Neymar, his father, former Santos president Odílio Rodrigues and former Barcelona president Sandro Rosell . DIS claims that the family of Neymar acted corruptly, and also charges Barcelona with compensation.
The lawsuit filed in Spanish court had been closed, but it was reopened in September and the complaint was upheld by the judge of the National Court, José de La Mata. Neymar’s family is accused of omitting the true value of the player’s transfer to Barcelona in 2013. Officially, the sale was signed at €17.1 million. DIS had 40% of Neymar’s rights, while Santos and Teísa owned 55% and 5% respectively. Parallel to the agreement, Barcelona paid €40 million directly to the company of Neymar’s parents. In the case in Spain, DIS understands that this amount was part of the negotiation and should therefore be shared among the then rights holders. The prosecution already understands that the parallel negotiation between Barcelona and company of the Neymar’s family violated the regulation of transfers of Fifa.
